"Application for Admission Withdrawn" and its effect on Spouse Visa Process

Hi,

I am Canadian, back in April 2015 I got denied entry to U.S. as I told them the truth that I was going to visit my husband. At the time, my husband and I actually didn't know it was illegal to start my immigration paper work while i'm in U.S. (how stupid were we) but I read online that one could apply from either inside U.S. or Canada and also at the time I was pregnant with our child. My passport was stamped "Application for admission withdrawn". My husband and I immediately started the immigration process from Canada (obviously) and our I-130 was approved on October 7, 2015. *yayyyyy* :joy:

Our baby was born in September, 2015 (L) and we would really like for her to meet some of my husband's family members in California (where my husband is from)- eventually she will get to meet them when my immigration paper work is completed but who knows how long it will take. What are the chances of me being denied again? And If i am denied, will it affect my immigration application? if yes, to what extent? like how bad? I'm looking to visit with our baby for 2 weeks then return back as I obviously need to do a police clearance here, medicals here in Canada, interview here in Canada so i definitely cannot stay in U.S. so please once again: What are the chances of me being denied again? And If i am denied, will it affect my immigration application? if yes, to what extent? like how bad?

Timeline:

June 7th- Interview

Result- Approved but missing original birth certificate

June 7th- Mailed original birth certificate

June 8th- Offsite facility received original birth certificate

June 13th- Consulate received original birth certificate

June 29th- Requested for passport to travel

July 8th- Received passport

July 8th- (didnt need passport anymore) mailed it back to consulate

July 9th- Offsite facility received passport

July 13th- Consulate received passport

July 14th- Sent emails to inquire about case, was told to give them an additional 8 weeks from JULY 13th to process my visa :ranting: , immediately involved Congressman AND our Attorney sent letters mid-july/end of august

August 9th- Issued

August 10th- Received tracking number at 2pm

August 11th- Received Passport at 11am(Markham, ON)/Crossed border. at 7pm (Pearson Airport Toronto)

August 16th- Went to Social Security office, was told my card was mailed out August 15th and I was able to jot the SSN down (needed for work)

(For SSN, when i was completing the DOS-260, I requested for them to have my SSN processed)

August 25th- SSN came in the mail :D

October 16th, RECEIVED GREEN CARD IN THE MAIL.

Baby will need a Consular Report of Birth Abroad (CRBA), this can be obtained anytime.

You've likely been flagged by CBP which means the chances of you being allowed admission at this juncture if you try to visit are next to nil. Being refused admission by CBP in of itself will not have an adverse effect on the immigration process.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Timeline

I'm pretty sure you can still visit if you meet the requirements you were given at the time you were denied. My husband was turned around at the border and given a list of things he will need to prove in order to come into the states for a visit. Return ticket, utilities etc. Also a friend of mine with US border control confirmed that as long as you have proof you're returning to Canada then you should have no problem.

You may want to contact the folks at the border and find out for sure before ruling it out.

It will not affect your immigration unless you are "removed", in which case you get a 5-year ban. If they let you withdraw admission, then you are not removed. If you are going through US entry checks in the US, it is their choice whether to offer you the option of withdrawing admission. Although I think that if you go in good faith, or you enter by land (and it's so easy to turn around), they should let you withdraw your admission. If you fly to the US by going through pre-clearance from Canada, I don't think it's possible to "remove" you when going through US entry checks in Canada, so that would probably be the safest option.
