K1 visa and being unemployed.

Hello,

I am new here and i am just starting to gather information on K1 visas for bringing my fiancé from Mexico into the US. I have been reading over the forums and see there is a minimum income requirement. Here is where my first problem exist. I have been living with my fiancé in Mexico for 6 month. My finances are derived from savings and a monthly payment from my former employer. When I return to the US with my fiancé i will find new employment but for now i show no traditional

income.

Is this going to be a deal breaker for a K1 visa?

It's not a deal breaker, but you will need someone to be your co-sponsor who can meet the financial requirements in your place. The co-sponsor must be over 18, a US citizen or LPR, and living in the USA.

Follow the K1 guide here on VJ and you will learn about all the forms needed to complete the journey.

The form I-134 is the affidavit of support. You will complete one as well as a joint sponsor.

Your brother or sister, who ever you have cosponsor, will have to show a tax return, W2, employer letter, and paystubs.

Just as a note though, they can still ask you to get ANOTHER cosponsor, even if you have one who "meets the requirements".

I'm unemployed, and my mother (our cosponsor) makes about 7000$ more than the minimum requirement for 125% and has worked at her job for 3 years, the Consulate officer still felt it wasn't good enough and refused the visa until we can find a second cosponsor, currently waiting on one to let us know if they'll do it. Had we have known we needed someone that made enough for four or five people, instead of two, we would have gone with the cosponsor we're looking at now.

A lot of people will just say "just find a cosponsor that meets the requirements and you'll be fine!", but from my own experience, you'll want to find someone who makes plenty over. I even sent a statement saying that I'm looking for work, etc.

For most people though, they don't run into this problem. We just seem to have gotten unlucky.

I figured I'd warn those in the same position as me, mainly because most people don't mention that sometimes meeting the requirements isn't actually good enough, so we went in expecting everything to be fine, and it wasn't. lol
