I'm anticipating a CR1 interview in a couple of months. I was in the US before on a J1 visa, for which I requested an advisory opinion whether the two year home residency requirement applies to me or not (the interview will take place before the two year is over). I was found not to be subject to the requirement.

For the interview I will bring my J1 DS-2019 form and the advisory opinion to prove I am not subject to the requirement. Could it be a problem that the advisory opinion is dated to the middle of my J1 program and not after I finished it? I have not participated in any other J1 programs, so I see no reason to request another advisory opinion. So my circumstances for my J1 had never changed, and that's the one the advisory opinion is for (my DS-2019 and program number is listed on the opinion). Will this be a good proof for the IO? Will they at all investigate the residency requirement if I check not subject to the requirement on the DS-260?

Hello,

Does it say on your visa that you are subject to that rule. Of not, I do not think it will be a problem. Unless I misunderstood your situation... I had a j1 visa too. Some automatically have the two year rule others do not and you do not need a paper proving that. If on your visa (on your passport) it shows that you are subject to that rule, I would call the embassy (since you have an interview scheduled already) and tell them about the paper you have. If it does not say that on your passport, then like me, you should not have a problem.

Very good question Syhem LNK!

My visa says I am subject, my DS-2019 says I am not subject. This is why I requested the advisory opinion. However, on the visa interview I will not have my passport with the J1 in it, because since then I got a new passport (I was never asked for old passports at visa interviews). I will have the DS-2019 and advisory opinion with me stating I am not subject.

During the visa interview, do they check your previous visas? Will the DS-2019 and advisory opinion be sufficient proving I am not subject?
