Hello everybody, I became a permanent resident in May 2011. I took 4 travels abroad, for a total of 317 days and I will travel abroad for 37 days on January, 2016. My travels are:

10/01/2012 - 10/21/2012 (20 days abroad)

12/31/2012 - 01/25/2013 (25 days abroad)

11/13/2014 - 05/08/2015 (177 days abroad)

05/18/2015 - 08/20/2015 (95 days abroad)

01/13/2016 - 02/18/2016 (37 days abroad)


Can I file N-400 on February 2016? Will my long trips abroad in 2015 broke my continuous residency? Is it advisable to cancel my international trip from 01/13/2016 to 02/18/2016? Thanks for your help.

It appears you have breached the continuous residency requirement. An absence of more than 6 months in any 12 months period will disrupt continuous residence. I'm not sure you should file a naturalization to bring this to DHS attention.


I am confused about the continuous residency requirement, I used to think that if you don't travel abroad for more than 180 days you are ok.

"Absence from the United States of more than six months but less than one year" in any single trip not any 12 months period. You may read the USCIS Policy Manual as: http://www.uscis.gov/policymanual/HTML/PolicyManual-Volume12-PartD-Chapter3.html

Yes, I think you are right boy15. I just got a little confused because an attorney told me that I have breached the continuous residency requirement because of my trips, you can check it here:

Do not listen to them ( I mean these so-called lawyers) You are fine. (I had something like 900 days abroad). You can go your trip in January and then file in February.

The magic number is a single trip greater than 182 days. The other magic number is greater than 912 days for a 5 year application or greater than 547 days for a 3 year application total time outside the US. If you exceed these numbers you are not eligible to apply for citizenship.

I am not sure about how much to trust the responses on those websites. Some folks there in my experience appear to provoke fear in order to force the asker to cough up the dollars to consult an attorney.
