USC w/ Typo on Middle Name on BC. Correct on Passport - K1 Visa

Hello!

I'm planning on submitting my K1 Visa application soon for my soon to be fiance. We met with a lawyer yesterday and she thought I had a very good package ( Just to sign in Black ink / don't need to include all of her passport pages, etc. ). However...

My Birth Certificate has my middle name spelled slightly wrong. It says "Louis". The middle name shown on my passport and almost all of my other records ( probably because I use my passport) shows Luis.

My plan was to include both my Passport Photo page and my Birth Certificate. On the cover sheet for the attachment where I'm proving I'm a USC, I make a note indicating that I acknowledge that there is a typo, and that the middle name of Luis has been used for all other formal documents.

Is this likely to be a mistake, including my Birth Certificate? I was hoping by being upfront that I know my middle name is spelled wrong and needs to be corrected will just give an excuse to delay. Should I just use my passport with all of the pages instead? I feel like the Birth Certificate does a better job of indicating I am a US Born Citizen.

Any thoughts?

I had a slight typo on my birth certificate too. Birth certificate had my middle name as Lindsay, my passport , driver's license etc. has it as Lindsey. I have always used Lindsey.

I didn't mention it, neither did anyone else.

Thanks for the reply. Did you include your US Passport as well in the package?
