Please help,

My fiancé just received her K1 visa approval in the mail (DHL) yesterday.

At her consulate interview she said the kids were going to "follow to join" later because her ex husband would not sign the release of custody documents for them.

She has now gotten him to sign the documents but we are not sure of what to do about her kids.

They were listed on the original I-294f application. We were going to bring the kids to the consulate interview but I had read here that if she did not have the documents for them to leave the country she may not get approved for the K1.

With the signed copy of the document from her ex she should be able to get them a Mexican passport (I am assuming that is needed).

Can we fill another DS-160 for each child and go back to Juarez for their interviews?

Do we have to wait until she comes to the US and gets her green card?

Thank you!!

Steve

She does not have to use her K-1 first. She can go ahead and get them the passports they must have. Log into the same site you had to before https://ais.usvisa-info.com/es-mx/niv

Same instructions, though a child's medical takes longer > http://ciudadjuarez.usconsulate.gov/medicalexam.html

Each child will need a DS-160, visa processing fee, and medical. I would contact the consulate to ask about the process for their interviews and if they must have one, can they all attend just one.

Thank you so much for your reply!!!

One more thing, I saw on a different website that she will need a letter signed from her ex stating that the kids can leave the country.

He basically is ok with not seeing them anymore but he wants her to sign something stating that he has received years worth of child support so he doesn't have to pay or be liable for paying it in the future. Nice huh?

Is there something stating exactly what type of letter this is or what it exactly needs to say? notarized? time limits or not?

Thanks,

Steve

My wife obtained a notarized letter from her ex-husband stating that he gave his permission for his son to immigrate to the US. Nothing fancy, just the facts. The US consulate in Guangzhou accepted it with any issue.

Your fiancee may want to contact her attorney that handled the divorce to check out the child support issue, that may result in amending the divorce decree. That is a separate issue.

YMMV,

Good luck on your immigration issue
