Hello,

I am confused whether I need to fill out I-864 or I-864EZ.

1) I am the sponsor.
2) I'm sponsoring both parents (Mom and Dad). (As per I-864 EZ one of the requirements is that-The relative you are sponsoring is the only person listed on the Form I-130 petition)
3) I have sufficient income (started working 1+ yr)
4) I file a joint tax return with my spouse.(As per I-864 EZ, you cannot use EZ if you are a joint sponsor, I provide support alone however my filing is joint and only have one year of income to show on tax return).

OR

​Do I need to fill out I-864 and I-864A​

If you have sufficient income, then you can use 864EZ but 1 year is not enough to show stable income. You need to file 864 for each parents and have your spouse fill out 864A to add aditinal income. The only difference between both forms is they are same but 864ez is short.

I agree as long as current income is enough. Then one year is plenty of time.

I was only at my job for 6 months when I did AOS for my wife and it was approve with no problems.

I am not sure if you can use the I-864A

it seem that you could since you will filing two forms one for each parents and you are using your own income. However the instruction arenit clear about filing a joint tax return

I am filling out the i864EZ form and kind of confused as to what I should answer.

5.a - Have you filed a Federal income tax return for each of the three most recent tax years?

I haven't filed for tax return for the last three years (only last year and joint with my husband), however I was also on his tax returns the past three years.

Should I answer "No"?
