Hi there! I saw you replied in my thread and we do kinda have the same situation :)

Actually I am not worried at all now because we talked to an immigration atty. his name is Nick Caraquel, he's Filipino as well but lives in the US for years now. He told us we have nothing to worry about as long as you have someone willing to be the co sponsor and they meet the requirements, you are good to go! Don't listen to the people saying it's a case to case basis! Just believe in yourself and hope for the best! God bless :) BTW atty. Nick offers to do all the filing for you and coach you on your interview for $2000, the filing fee is already included too. Consulations are free though, just join the group "US VISA (k1/cr1/Ir etc.) ask your immigration attorney" on fb

If you want someone to fill event out and send it off, also has a office right next to the embassy and will also coach you and sort your papers for the interview rapidvisa is less than 400 bucks. And like I said they have an office literally across the street from usem. They aren't needed at all, but if you wanted to go that route why choose someone in the states that charges way more and either will coach you proxy through your fiance or over skype/the web?

Co-sponsors are approved on a case by case basis with the K-1 visa at USEM. It helps if your co-sponsor is a close relative (father, mother, brother, sister). If you income exceeds the 125% poverty guidelines of the I-864P you will have no issues. Required documents with the I-134 for the embassy is your most recent tax return and W-2. If you are a newer employee, a letter from the employer and pay stubs are good to have also. Bank statements are not needed.

You attorney is talking out of the party of his body that he should be using to sit in a chair. Co-sponsors are not "good to go" with the K-1 visa, it is strictly at the discretion of the CO during the interview. Obviously Nick doesn't do many K-1 visas at USEM

One plus as of late is that many applicants during the interview are not even asked for the I-134 and supporting documents as of late. You could get extremely lucky ;)

Hello FutureMrsM., I just remembered that you mentioned that he is coming for the interview right? and he is staying for 6 months? I just want to let you know that, if your visa get's approved, it's only valid for 6 months. So don't forget to plan the date of your departure before your visa expires.

I don't think that we need to spend extra money for that 'coz we started everything by ourselves already and haven't encountered problems yet (hopefully not as we continue). I have one more concern. I (the beneficiary) just left my job recently and in the Form G-325A for me that we included, it's still stated that i am employed. Would that be a problem if i am unemployed before my embassy interview?

Also when i get back in the US, i would like to get a job too so i can help my fiance w all the expenses. I know we have more papers to fix by then.

You can go ahead and schedule your interview once you have your case number. The letter comes in late recently. Start arranging your files/documents http://photos.state.gov/libraries/manila/325288/packets/K1%20and%20K2%20Interview%20Preparation%20Instructions%20-%20English%20_10%20October%202013_.pdf You don't have to wait for the packet either. It rarely arrives. We never got one. Just follow the instructions on the link.

I am not entirely sure on how long you can delay the interview. We scheduled right away so I have no experience on that. Although from what I know, the approval of i-129f is automatically extended for a year.

But this I am sure, once you have your visa it's valid for 6 months, 1 time entry.

Thanks to everyone for responding to my questions. Everything was really helpful.

About our NOA2, we haven't receive the hardcopy in the mail yet and also in the email. But in the USCIS website, our case status was "APPROVED".

Here's our timeline:

10June - Sent I-129F

12June - Delivered at Texas Lockbox

16Jul - USCIS Website: Case Approved

20Jul - Receipt Notice (NOA1) Email

24Jul - Receipt Notice (NOA1) Hardcopy

I'm a little confused. in the USCIS website it says that our case is approved. That means we're now waiting for the NOA2, right? Correct me if I'm wrong please. We are waiting for the NOA2 but we still haven't got it even through email. And is it normal that our petition takes a little longer than anyone else's? (I've been looking at other people's timeline here in VisaJourney and I'm kinda starting to panic.) Is it suggested that we call the USCIS Customer Service to follow up or should we just keep our cool and be patient? I'm sorry for my queries.

Oh and I noticed in our Receipt Notice (NOA1) there isn't a Priority Date. I thought we need a Priority Date for something really important in this processing. Then in the Notice Type it states: Approval Notice Valid from 07/16/2015 to 11/15/2015. Does that mean our petition request will expire after 15November? I hope not and I hope we get the NOA2 before our NOA1 gets invalid.
