I would try to enter as soon as your senator clarifies what exactly your status is, the BP may or may not let you in so try and hopefully

they will keep their discretionary interpretation under check and allow you in. I agree that no one can guarantee you entry

due to the discretionary authority of the BP and their interpretation of the case.

Ebunoluwa, we got an e-mail from our senator's aide:
"We usually like to give the agencies 15-30 days to respond to our inquiries. This gives them enough time to look through the file and provide us with a response. Sometimes the agency will respond quicker. Once I receive any information, I will contact you. "

30 days???? USCIS could not examine one small paper for 3 months (deadline!), and now a senator gives them another month?! Where is a difficulty just to take our case, look at only 2 pages of paper and make a decision, so we would not lose our time and nerves? I lost any respect to this country after they took away our everything (I lost another semester in the community college!) for one stupid insignificant mistake of my husband (not mine), which took him only 1 hour to be fixed.

Since my spouse has European Union member passport, I prefer he just renounce his stupid American citizenship. I don't need anything from this country. I had enough, I'm fed up. The only thing I am not sure is if he has to get rid of all of his property in the U.S. That he would not be allowed to get any income from USA I know. He took mortgage for our house on January, but if USCIS does not let us live there, we do not need it anymore.

I understand you are very angry and I would be too but try to give it more time to see what happens and set your emotions aside

so you can deal with this rationally. You are in queue and it is what it is. You have come too far to recoil now. Stay the course, you have a

Yes, that is ok, the senator works faster than Ombudsman.

Oh, I read that an ombudsman starts acting only if a case is 60 days out of normal processing time

My spouse sent e-mail to the Ombudsman anyway. It is free, so why not to try!

I was also thinking about filing a Waiver of Grounds of Inadmissibility, but there is asked to explain the "extreme hardship" my qualifying relative (U.S. citizen) would experience if I am refused admission. I-601instr.pdf. This "entertainment" costs $585. I don't think the 50% loss of our income is "extreme hardship" for them.

How unfair! The wife of their citizen never having broken their laws, so ridiculously became inadmissible home! One tiny bureaucratic mistake, and now I have to get prove them "extreme hardship" (what, for example?) to be allowed to go home! As if our loss of thousands of $$ and lost months of life are just "hardship" but not "extreme" enough for these idiots.

Just in case somebody is interested. A week ago uscis reopened our case and sent us RFE for new I-693 medical exam because while we wee waiting for their decision, mine initial one has been expired. Found one normal certified physician who is agree to give us results in 3 days and give a copy of completed I-693, all for $200. Right now I am on layout in New York (crossed the border successfully with my Advance parole restored!), my man met me there ☺. In 7 hours we are flying home together. Tomrrow morning I am going to medical exam.

I hope they will leave us alone soon! Just thinking, these uscis idiots may also request for new biometrics.

RE- Biometrics, they are also good for a determined period of time, Im fairly confident its one year as well. So you may or may not get a notice for them (depending on when you did them last). For some reason USCIS has been enforcing the medical only lasts for a year so you need to redo it policy hard and heavy the last few months. So you are not alone in needing to redo it through no falt of your own. It expired while processing which stinks because thats not your fault but policy says if it does you need a new one. They havent been seeming to enforce the new biometrics if they expire BUT they can so just see what happens. Hopefully your status just changes to card approved/sent out.
