Hi :yes:

My fiance and I started this process a few years ago, broke up, he married someone else, is now in process of getting that marriage annulled and we want to marry. I'm assuming his annullment has to be complete before we can even file for K-1? And, does he have to check that he is divorced and include proof of annullment? Also, where are the I-129f's going these days? It appears that for K-3 they're going to Missouri, but what about K-1?

Both parties must be free to marry before you can file. Dependant on where you live will determine where you file. Look at the I-129F form and instructions. You might find them quite informative.

You cant start it until the annulment is completed and you will have to include proof of the annulment as part of the application. K-1 goes to the service center covering your area, which is either Vermont, California, Nebraska or Texas. The form tell you which center to sent it to.

Thanks for the replies. I am familiar with the forms and Texas is my service center. There is no processing time listed for Texas for the I129f. I thought at one time they were going to California so I don't know what is going on there. Apparently the I-129f for K-3 goes to Missouri? I wondered about the marriage/annulment issue because on the form it lists divorce, but not annulment and one reason for annulment is to make the marriage as if it never was... So, I'm doublechecking that point. Processing times everywhere else for K-1 seem to be July 17 so maybe Texas is just updating their time? Thanks to anyone that knows :-)

I think we all understand annulment... The USCIS requires both parties to be free to marry...... that is it... whether that occurs via divorce or whether the marriage never occurred.... you need to be free to marry....

Only two service centers do I-129f petitions for k-1. All Nebraska and Texas go to California. USCIS reported processing times are not reality... 90 days or so for California seems to be typical.

Actually I-129F for K-3 goes initially to Missouri and then typically gets transferred to Vermont or California.
