When can you leave the US and be able to come back?

My dad just got here for about 2 weeks. He is thinking about going back because his house in China is getting demolished by the government so he needs to go back. Can he come back if he leaves in early July? He got his SS card but not his Green Card yet.

Dad came in on IR-5?

If Yes:

Study his visa foil stamp, the line containing the word 'endorsement', then look for the stamp in the passport from the POE.

In essence, the VISA with this stamp in the passport just turned into an I-551 document, a temp green card, with 1 year duration. Technically, he could have turned around the same day he arrived and gotten on a plane headed back to China.

If No:

Uh, you got him in on a tourist visa, and filed the big Adjustment of Status package? If yes, if he leaves, he will been seen as abandoning his adjustment of status and you'll have to start over.

You need to give us more details. How did he enter the country? what visa? did you file AOS already?
