Notice of Potential Interview Waiver Case, case delay more than a year now

Hi every one,

I applied I-485 via family base, (my daughter) . they received my application on March 11th 2014, did the finger print. Then on June 27 2014 I received a letter(Notice of Potential Interview waiver case) saying that I might not need to go to the interview. The letter also say that due to work load that not related to my case, they anticpates a delay in completing my case, the delay to be approximately 6 months. Now its more than 6 months since I received the letter, my case still pending. I contacted USCIS customer service to request the case status as the case has been out of normal processing time, and again, nothing change but still pending. The letter signed by Robert M. Cowan, from USCIS National Benefit Center in Lee's Summit. Is there any way you can help? Much appreciated.

You should contact the DHS Ombudsman: https://cisomb.dhs.gov/oca/form7001.aspx and/or one of your congressional representatives.

Same advice as previous posts. You need to contact Ombudsman and your Congressman to deal with USCIS. Many of us got positive outcome after contacting them. Good luck.

New Journey AOS:

My fiancee came to US on the 8th of March, 2014 under K-1 visa at Newark, NJ Airport for POE.

Applied Social Security Number on the 10 of March, 2014.

Married on the 13th of March, 2014.

Sent I-485, I-765, and I-131 on the 15th of March, 2014.

Received EAD on June 7, 2014.

Received Notice of Potential Interview Waiver on July 1, 2014 date 6/27

Contacted Ombudsman on 01/12/2015.

Ombudsman contacted USCIS on 02/20/2015.

Ombudsman sent a follow up to USCIS on 03/18/2015.

I-485 approved on 03/31/2015 ( we ordered your card).

Welcome notice was mailed on 04/01/2015.

Received Welcome Notice on 04/08/2015.

Card was mailed to me/picked up by USPS on 04/08/2015.

Received GC on 4/10/2015.

Same advice as previous posts. You need to contact Ombudsman and your Congressman to deal with USCIS. Many of us got positive outcome after contacting them. Good luck.

OMG, look lile they sent the notice same date as mine. If I've known this Ombudsman stuff, I would have gotten the green card. Thanks so much for your info. That kinda give me a little relief.

Hi, hope this message reach you well,

I filled the form from the Ombudsman on May 30th 2015, they said it takes 45 business days. does it really take that long ? its almost 45 days for me but there is still no updated from them. My case has not even assigned to an analysis yet. Should I worry ? And how do I contact my Congressman ? Sorry if I have too many questions.

It is 45 business day not including weekends. You can also call Ombudsman office to ask for your submission's status. For your congressman, I assume you are living in Santa Ana, CA, hence you would go to this website https://lorettasanchez.house.gov/services, and then click on Serving you> Request Help. You will need to fill out some info and explain why you need help. You are then printing out, signing, and including any copy documents related to your I-485 such as I-485 receipt and Interview Waiver Notice letter before sending to the office address. Good luck.

Okay, its been so frustrated for us. We went to the interview and they denied the form I485 but they approved I130. The reason they denied was that while waiting for the I485 result, I went back to Vietnam and I used visitor visa to enter to the USA two time which conflict with the application of I485, they considered that I abandoned the I485 application. I have should applied for the reentry permit but I thought I might wait until the result.

Anyway, the officer gave us the letter of I130 approved and mark on the section that I was still in the USA and I should apply for the adjustment status within 30 days. Now thing been going on a lots in my family and I had to go back to Vietnam , I did not file the I485 and it passed 30 days period.

Then I received the notice from USCIS saying that they approved I130, and asked me if I wanted to file I485 while in the usa or decided to file out side the USA.

What should I do now? I still have my visitor visa valid to enter to the USA, can I use the visitor visa to enter the USA again then file I485 ?? or I have to apply from Vietnam? They asked if the petitioner decided to file out side the USA then we have to file I824??

Please give me advices . I am very appreicated your help.
