What? Wow....um... :huh:

It's a strange situation, but you probably can. I haven't come across anything saying you can't. You may need to make sure your relationship to your new squeeze is air tight - otherwise, an officer may suspect fraud. Or, you might not even need to mention that the co-sponsor is your ex.

If he meets the income requirement and is willing to co-sponsor your fiance, then sure. Those documents won't be needed with the I-129F petition though. They will be required for the K-1 visa interview. Also, make sure you do not submit the I-129F until your divorce is final and you have the divorce decree.

He is willing to sponser her. but the tax returns have his name on them too and that's what worries me about this. do you think that will be a problem?

I suppose it could be questioned, but some people do remain friends with their ex-spouses. I believe I have seen posts from a couple other people that used their ex, and it went through. Just answer anything they ask truthfully.

yes we are and yes it's legal in California now
