So before im going for the questions im going to give you the story of us , We got married in sep last year and after that I went back to sweden and she stayed in the US , we was skyping everyday while apart trying to figure out if we wanted to live in america or sweden. We couldn't really make up our minds and we didn't want to stay apart for much longer so after about three months apart I bought a ticket for her and she's been in sweden with me ever since (she came here in Dec 2014) When she came she was only here on a visa waiver. That expired in march so she overstayed. And I tried to get her a proper visa and failed for numerous reasons.

On the I-130 it says "give last adress at which you lived together" so then I would put my adress from Dec 2014 to present. But that present a problem since on the G235A she is suppose to state her current adress and she can't really put mine on there since she dosen't have a permanent swedish residentship and my adress isn't technically her adress (her mail isn't forwarded here or anything) . What should we do? If we put my adress on the I-130 and on the G235A will she have to prove domocile? She isn't even allowed to stay in sweden anymore but we just don't want to be away from each other.

And one more question, the check that we have to put in with the packade says : TO THE ORDER OF UNITED STATES DEPARTMENT OF HOMELAND SECURITY for "and then her name" is that correct? :S I thought it should say from "and then her name" TO UNITED STATES DEPARTMENT OF HOMELAND SECURITY ??

Note: its a cashiers check if that helps.

I'd very much apprieciate any help on this :)

So, I'm confused. Are you suggesting that FRAUD and LYING is acceptable and an actual choice? You intend to lie and not tell the truth about address and everything in the hope that nobody will notice. You don't really believe they know she overstayed her visa?

You're not going to be successful in manipulating the system by lying - be it today or at the interview.

"not technically" ... a fancy way to say an illegal alien. Why can't she go to her own country? She lost or gave up citizenship in Sweden?

You answer truthfully and suffer the consequences. That is the only answer there is. "America is advanced citizenship" which really means you follow the laws and processes. She is illegal, are you saying she is still illegal and in the US illegally? I understand, I think. But, you're trying to find a way to make it all okay, and it's not. This is exactly why the laws exist.

We're not in America!! AND my wife is NOT from Sweden nor does she have a swedish citizenship! She is an American Citizen, that is currently in MY country. You are aware of the fact that Americans can be illegal immigrants too, right!?!

You obviously don't have a clue about anything! I suggest you read carefully next time before you reply. Stop trolling my topic and move on!

The Swedish government will not see these forms. So if the petitioner is living somewhere illegally that is the issue with that country not the US government and you should be truthful on the forms.

While I think living anywhere illegally is reprehensible, it doesn't have any bearing on you for a US immigration standpoint. She should return to the USA at the very least before submission of the I-864 so you don't have to deal with domicile.

Yes we are ofcourse going to be truthful I was just wondering if we should put my address (in Sweden) as her address even though she doesn't have a visa here. Because in reality as far as the swedish government is concerned she's not a resident here so I just want everything to be done correctly that is why I'm asking so they wont think we are lying. Thanks for you help.

Like i said, the Swedish governmwnt has nothing to do with this and whether the oetitioner is legally residing or not is moot, but if she has a US address still she should use that as her address.
