K1 VISA RFE Intent to Marry

Hey guys, so I submitted the K1 visa package roughly a month or two ago, and last week received an RFE regarding intent to marry.

The odd thing is, In my initial package, which I sent to Texas, I included both a letter of intent from me (Petitioner) and a letter of intent written by my fiancee'. Both signed, dated, and included in the package. However, my package, when it was received in Texas, was then sent to California to be handled. Is it possible that my fiancee's letter of intent was misplaced? Lost in transit? Or are they suggesting that the letter was insufficient? I'm just trying to figure out how to properly respond to this. They stated in the RFE that intent to marry includes letters of intent, wedding preparations, etc. But as of this point, we have made no official wedding plans because we have no idea when, or IF, the K1 visa application would be approved. Therefore, all we have to submit in terms of intent to marry, would be these letters.

I sent the original copy of her letter of intent, and I have a scanned copy in my possession now. I was considering to scan another copy of her letter of intent, and mail that in response to the RFE, with a letter stating that the original copy of her letter of intent was included in our first submission. Any other advice?

We received a RFE regarding the same issue. In order to have enough evidence (better safe than sorry), we included NEW letters of intent from both of us, messages in which we talked about the wedding with each other and with people that are in the wedding. Also we haven't made final plans we included an outline of wedding plans. I would suggest to do the same thing. Although they can't expect you to make reservations etc because an approval is not guranteed, write a letter telling them what your ideas of what the wedding will look like are.

The most important thing though is that you both state that you do intent to marry within the 90day period given on the K1 visa.

Thanks for your reply! The only issue with including new letters of intent would be requiring her to write something new, and mail it, which could take a week or two to arrive to my place, so I could mail it directly to UCIS. That is a good idea though. I wish they would have specified further, stating if the letter was missing, or insufficient.

They probably lost it, which is super annoying!

Good luck!! Although getting a RFE is a huge bummer it also means they are working on your case and if everything goes well, you will have an approval in just a few weeks :-)

Your case got adjudicated really fast so the additional week or two of getting the letter is much easier compared to others who have waited 8 months or so. I'm glad you are being optimistic in seeing the good in getting the RFE. And yes, letters of intent sometimes get lost but at least its an easy thing to settle.
