Hi,

I am using my own income for the AOS.

My employment offer includes "non-guaranteed" yearly bonus, although everybody really gets year end bonuses.

Last year, I got $x,xxx amount for bonus and have pay stub to show it. The employment certificate I have however, just have my annual salary.

Do I put the annual gross salary + anticipated bonus as income or just the annual salary?

Also, I received a month of unemployment last year (Jan 2014) since I started my current job on Feb 2014.

Do I include the 1099 unemployment income with my W2 in the AOS packet? My annual salary is above the guidelines.

On the I-864 form. you will put your current annual income that is on your employment letter. Bonus and deductions are not guarantee and do not count when figuring annual income. You will not include the unemployment income for your current annual income . However you will need to include it on IRS tax form if you have not filed your taxes yet.

If you send in a tax transcript with the I-864 you do not have to include the w-2 or the 1099 forms. If you are sending in a copy of your tax form, you will have to include the w-2 and the 1099 forms

I would just submit 1040a with 1099g and W2.

To avoid this problem of what to include with a copy of your tax return and a possible RFE for not submitting a COMPETE tax return, I would goto the IRS website and order tax transcripts for the last three years and submit those. USCIS considers the tax transcript a complete tax return.

Sending tax transcript is better as mention, with the transcript there is no need to send copies of anything else. you can download and print a transcript online free from the IRS website .

If you still want or need to send copy of your 1040a, then yes you will need to send copies of your w-2 and 1099g also, for the I-864 form
