Hello everyone! I'm new here and I hope somebody can share their answers on my case.

I'm in the process of petitioning only my mom. I grew up with my mom and never had my father all my life. My father has his own family now. My mom said that she was never married to my dad and that she's single. However, on my birth certificate (NSO), it has a DATE OF MARRIAGE, the informant name is my mother's name using my father's last name but she signed it as her single name. On the I-130 form, her marital status I checked Single (knowing that she was never married). What actions do I need to take? Do we need to correct it thru local civil registrar's office and then have it forwarded to NSO? Does somebody have the same situation as mine? How did you do it? I really need your help!

Thank you.

If you need clarification about whether your mom was married or not I would suggest is getting a CENOMAR from NSO, this will show your mom to be single if she was never married.

As for your birth certificate I don't know that I would bother doing anything with it.

Hi Hank_,

Thank you for your response. That's what I told my mom to get her cenomar and a marriage certificate (that would say not married) at NSO. I won't send the paperwork not unless everything is clear and good on her end. I hope this won't be a challenge coz what matters is to proof that I am her daughter.

Your mom is listed on your BC as married, and her name shown is a married name yet she signed it with her maiden name? Am I understanding correctly.

Your's is not the first BC that is, should we say, confusing.

I would for sure would get a CENOMAR to get that cleared up first. Then I still don't know that I would try to change your BC, after all your mom is shown there, with just a slight confusion ;)

I know it is confusing. I have already decided not to change anything on my birth certificate (we have to get a lawyer, go to court, which is very expensive and then wait for couple of months). I just hope they will not take a look at her date of marriage.
