The only real problem is that the ITIN is for people who do not qualify for a SSN--you qualify for a SSN. Yes, you can apply for one and the IRS will give you one, but you are lacking one of the required documents so I would not waste my time chasing down the ITIN, but I would see about renewing your passport. I would also have your husband compute his taxes and make any necessary payments. Then file for an extension. That will give you until October 15th to get a SSN. Once the EAD arrives, you go to the closest SSA office and apply for your SSC in the name on the EAD. Once you have the SSN, file taxes as MFJ to maximize the tax benefit of being married. The IRS gives you the option of filing for an extension as long as your taxes are paid, if owed, by April 15th. Otherwise you incur interest and penalties for late payment. Take advantage of the IRS rules to help with your situation and do not think about those sleeping pills.

thank you so much for the reply..I have a question though, if we will not apply for w-7 for ITIN and just file married filing separately and put NRA in the box where the SSN# is required would that still be ok? and sorry you all for my post about sleeping pills I was just being crazy with all the things.There is no way i will go that far.hehe.. :) I am happy now that things are getting clear with all your answers.You guys are awesome!

Yes, he may file Married Filing Separately and put NRA in place of a SSN. If he is using tax software, it may or may not let him e-file. A user reported that TaxAct worked fine with NRA so hopefully the other brands like TurboTax and H&R Block do also. Next year it will be easier to do taxes.

Meanwhile get your passport renewed. You need that for many things.
