Refiling a K-1 Visa

Hi, All,

My fiance entered the U.S. 2 weeks ago on a K-1 visa. Earlier this week we learned his mother was admitted to the hospital with a terminal illness, and he left yesterday for Brazil to be with her. As we didn't have enough time to marry, file for AOS, and schedule an InfoPass appointment to request his Advance Parole, we recognize that means having to start the K-1 visa process all over again. Given the long wait times for processing, I'd like to file a new I-129F petition as soon as possible. Here's my question. The original expiration date on his K-1 visa was March 25th. Since, technically, the K-1 visa expired upon his entering the country, I was wondering whether I can file a new I-129F petiton before that date, or is there something I must do to "cancel" the K-1 visa first?

I think there is a chance they can re-issue the visa if you are still before the expiry date. You need to contact the embassy and explain the situation. Good luck.
