Hi All,

I'm starting to fill out form I-130 for my wife and two step children.

First off, is there anywhere here that outlines and explains every single line in the application process? What may appear obvious might not be.

Second, here are my specific questions for the I-130 form located here: http://www.uscis.gov/sites/default/files/files/form/i-130.pdf

1. For my two step children (from my wife's previous marriage) - do I fill one of these for each of them as well and select "Child" under Line 1? ("I am filing this petition for my: ......")

2. Line 8 "Date and Place of Present Marriage" - this is referring to the specific date we were married, and specifically where we were married, correct?

3. Line 10: "Alien Registration Number" - what is this? Do I as an American citizen need to fill this out and does my Wife, an Australian citizen need to fill this out?

4. Line 16: "Has your relative ever been under immigration proceedings?" http://screencast.com/t/QhyrwxLFY6 -She was born in New Zealand but became an Australian Citizen when she was a little kid, should I be selecting Yes here? And if so, how should I fill the rest?

5. Do I need to fill in this section in the bottom red box here? http://screencast.com/t/QhyrwxLFY6

6. Line 17: "List spouse and all children of your relative." I know this sounds obvious but this SHOULD be her, my spouse/wife and her two children from the previous marriage, yes?

7. Line 18: "Address in the United States where your relative intends to live." -- How should we fill this out if we do not yet have an address? My parents have an address in the county we intend on living, but I don't that's suitable?

8. Line 19. "Your relatives's Address abroad." -- This is still referring to my wife correct?

9. Line 20 "If your relative's native alphabet is other than Roman letters, write his or her name and foreign address in the native alphabet." - ??? This seems odd. Do I need to list her name and address again? I just listed her name in line 17 and her and my address in line 19.

10. Line 21 - "If filing for your spouse, give last address at which you lived together." - We currently live at the address we placed on line 19. Should we list that or should we list the previous address?

Section D. Other Information

1. "If separate petitions are also being submitted for other relatives, give names of each and relationship" -- Should I place my step son and step daughter here? Should I do this even though they haven't been legally adopted.

2. "have you ever before filed a petition for this or any other alien If yes, give name, place and date of filing and result." -- Should I list here that we applied for a De Facto Relationship Visa here in Australia and it was granted?

Thank you in advance to any amazing individual who choose to assist!

I haven’t done the 130 but your question #2 would be yes, date and place of marriage is asking for the date and location.

#3- your wife should have an alien registration number if you’ve submitted a petition, if this is your first step then you don’t have that yet, again not familiar with your process.

#6- yes

#7, you have to put something so if you’re staying with your parents to start before you get your own place then yes, put that. When you move you will have to notify them.

#8- yes, your wife

#9- some languages don’t use our alphabet, so if her name is typed with an alphabet you’re familiar with then you don’t worry.

10- you list exactly what it states, where you last lived together, past or present

Other than that, look at the example forms to help you and hopefully someone who knows your process better can answer more specific questions for you

Hi All,

I'm starting to fill out form I-130 for my wife and two step children.

Not sure

2. Line 8 "Date and Place of Present Marriage" - this is referring to the specific date we were married, and specifically where we were married, correct?

Yes

3. Line 10: "Alien Registration Number" - what is this? Do I as an American citizen need to fill this out and does my Wife, an Australian citizen need to fill this out?

If you are born USC then you don`t have one. If you are naturalized USC, A# is in your naturalization certificate. AS for our wife...she has A# if she has been issued US visa *tourist,..etc..

4. Line 16: "Has your relative ever been under immigration proceedings?" http://screencast.com/t/QhyrwxLFY6 -She was born in New Zealand but became an Australian Citizen when she was a little kid, should I be selecting Yes here? And if so, how should I fill the rest?

It is for US immigration purpose only...if she never immigrate to usa, check NO box.

5. Do I need to fill in this section in the bottom red box here? http://screencast.com/t/QhyrwxLFY6

6. Line 17: "List spouse and all children of your relative." I know this sounds obvious but this SHOULD be her, my spouse/wife and her two children from the previous marriage, yes?

current spouse an her children, so your wife names and her children names if they are immigrating with her.

7. Line 18: "Address in the United States where your relative intends to live." -- How should we fill this out if we do not yet have an address? My parents have an address in the county we intend on living, but I don't that's suitable?

You can fill your parents address or fill to be determent

8. Line 19. "Your relatives's Address abroad." -- This is still referring to my wife correct?

yes

9. Line 20 "If your relative's native alphabet is other than Roman letters, write his or her name and foreign address in the native alphabet." - ??? This seems odd. Do I need to list her name and address again? I just listed her name in line 17 and her and my address in line 19.

fil N/A

10. Line 21 - "If filing for your spouse, give last address at which you lived together." - We currently live at the address we placed on line 19. Should we list that or should we list the previous address?

Were you live now...so it is the same address as is at 19

Section D. Other Information

1. "If separate petitions are also being submitted for other relatives, give names of each and relationship" -- Should I place my step son and step daughter here? Should I do this even though they haven't been legally adopted.
