Hi everyone,

If anyone has a minute, and could help, it would be greatly appreciated!

All the source and information on VJ is so much help. I've learned alot the past several days reading through all your posts!

My boyfriend, residing in CA, USA previously married and sponsored his ex-wife about 6+ years ago, now they are divorced. (Approx 4yrs now)

As I am going through the I-129F, section 14. It asks if he has ever filed for this or any other alien fiance(e) or husband/wife before?

Does he answer yes?

Also, to prove that one is legally free to marry after divorce. A Divorce certificate is what's required, correct? Or do we have to go see a lawyer to request for a certified document?

As I am not in the USA with him, I have not yet been able to go through his divorce documents. He knows little English, insists that he'll seek a lawyer to do he K-1, but from what I see and have read on VJ, the process seems simple as long as all requirements are met. (Also want to save on the extra costs).

Correct he will answer 'Yes" and also fill in the pertaining information about her that is requested on the question #14.

Divorce decree can come from the County Courthouse they keep a copy on file if he does not have a copy.

If he gets a copy have him get it certified at courthouse and keep original for interview.

Clarification on "original" divorce decree vs "certified copy". The actual "original" is always kept at the courthouse. All you ever get is a "certified copy". This is what you'll physically bring to the interview to show them, as opposed to what you send in with the application, which is just a plain old photocopy of this "certified copy". Same goes for birth certificates.

Certified divorce decrees can be obtained from the county clerk where the divorce was recorded.

If he has lots of money to spend, then yes use the lawyer, he will still have to do all the document gathering work.

Hmm, not sure what you're disagreeing with, VOL. Yes, you will certainly have to pay for the certified copy. My point is that you only need one certified copy which you take to the interview to SHOW them, and then you keep for yourself. You only need to SUBMITt a REGULAR photocopy (of the certified copy) with the application. Of course if you make the mistake of submitting the CERTIFIED copy with the app, then you probs won't get it back, in which case you'll need another one for your records and have to pay for it again. In any case, I think the OP understands what I'm talking about, so that's the main thing.
