Hello VJers!

We are planning on applying for CR1 soon, though we are not going to be in states for next couple years in order to go to school in canada. We are starting school(both hubby and me) in september. If we apply late jan we should be able to have interview around next jan I suppose my hubby can fly back to India to attend the interview, my parents can provide me the affidavit of support I guess as I wont have my job at the time of interview.

Do you guys think it will work out fine if we both are in Canada?

Any suggestion advice is welcome! Thanks.

From my understanding that will work if you can spend 6 months of each year in the States. If not, then I don't believe that will work, though I could be wrong. You are better off waiting until you are finished studying in Canada.

Or, wait until about a year before you're done with school and then start the process so you can finish it aa you finish school and are ready to live in the US.

yeah, you can time it. I would file 1.5 year before finishing to be safe in case your fiance is stuck in AP.

Echoing the above - file anywhere around 18 months to a year before you leave Canada. Bear in mind that the beneficiary will only have limited time to travel to POE once the visa is approved.

The reasoning behind this is that later on when removing conditions and applying for citizenship the beneficiary needs to prove that they have been present in the US for a set period of time.

Can someone tell me whats wrong with filing now and attending school while the CR1 is completed and we can move together to US after school? We' only be a few hours away from my parents and probably can visit US very often after He gets the visa.

Nothing wrong with starting the process now. It's better to start it now actually, but don't get the visa until you're ready to move. You can delay the process you just can't speed it up.

So can you delay the interview till you are ready?

Yes by delaying sending in paperwork at the second stage of the process.

Most of us have wanted to go as fast as possible, but it's pretty easy to slow down. You have a year to contact the NVC in between stages.

The petition however, is a different story as you have zero control on it unless requesting an expedite for something like military deployment or extreme illness.

Because a CR1 isn't for "probably" visiting "very often" -- it is for residing in the US. If it becomes clear to an officer at the POE that you are actually still residing in Canada and only visiting in the US -- especially if he is using benefits only available to residents of Canada for school -- they could cancel the green card and you would have to start all over again just when you most want to be in the US together.
