misspelled last name

Hello everyone,

I need your help please, my last was misspelled when my fiance received the NOA1. He already called NVC but they said that its going to be me who will be able to fix it when I receive the packet from manila embassy, which i think i wont be able to becuase everything is online for K1 visa.

What will I do?

Just make certain the NOA2 has the correct spelling, but it is not that critical. The critical part is after the K-1 interview in the PI, that the name on the visa exactly matches the name on your PI passport. Then make certain you use the last name you want for the GC application when filing the adjustment of status (AOS) after getting married. Verify that the name on the GC is correct as that will become your official ID. No one ever saw our NOA1. It just tells you that the petition has been received. A copy of the NOA2 is required for AOS, but you can explain the misspelling by showing it is still incorrect--I bet it will be as the NOA1 has the name associated with your case. Your fiance contact the USCIS with the A# on the NOA2 and get them to change the last name spelling. I would just make very sure tha the visa name is correct.

Hi dave,

Thank you very much for the information, I really appreciate it. Okay, I will let let my fiance know so he can call USCIS. the last time he called USCIS, they said that they have nothing to do with it anymore because they already sent the files to NVC... so we called NVC and they that Manila Embassy can take care of it.

You have only received the NOA1, not the NOA2 yet? You should be calling USCIS on this not NVC. ;)

Don't worry about the misspelled name if it does not get corrected before reaching USEM, make sure everything is correct when your complete the DS-160 and setup your account at USTRAVELDOCS. CO can make correction during the interview if needed.

Hi hank,

We also called USCIS but they said that its out of thier hands so they can't do anything.. We called NVC too and they said that they can't so anything about it anymore and that we need handle it with U.S embassy here in manila.

Thanks for the help Hank, Appreciate it... I will make to make everything correct on the other documents moving forward.
