Hi all,

I'm new to this forum and looking for some advice on completing the N-400 form.

I have been married to a US citizen for over 10 years and a permanent resident since 2008. Do I need to apply under the 3 year rule (married and living with a US Citizen) or can I apply as a permanent resident under the 5 year rule?

I’d like to if possible apply under the 5 year rule, but not sure if this will delay my application?

you are totally fine to apply based on the 5 years. It's less work as well.

day 43-- 05/23/2012-- Notice for an interview is received for 06/26 @ 2pm

day 63-- 06/12/2012-- Received a Text & email for an update- Card production EAD/AP

day 77-- 06/26/2012-- interview / approved on the spot.

day 86-- 07/05/2012-- Received my GC in the mail.

ROC

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

Applying under the five year rule will require less paperwork. You can do it either way, but I see very few reasons to apply under the three year rule when you are eligible under the five year rule. Go ahead and apply under five year rule.

I have the same situation as well, been married for 5 years, applied this August under 5 year rule, passed interview 2 weeks ago, no problems or questions from the officer whatsoever. And no headache gathering all the paperwork, this works for me!:)
