So this is unbelievable that I've received a RFE and they want I got my NOA1 on Nov 25, in my i129f I included not only a letter that inventoried my "Documents that demonstrate intent to marry" I included:

  • Letters of intent to marry (Petitioner and Benificiary - one each) Signed in BLUE ink to make sure they knew it was an original
  • Evolution of relationship letter
  • Chatlogs
  • Invoice for engagement ring
  • I-134 affidavit of support
  • 3 years tax returns
  • Letter from employer
  • 2 pay stubs

The document I have says that they need "evidence that you and the beneficiary intend to marry within 90 days of the beneficiary's entry to the United States as a K-1."

Well, fortunately we have emails between venues, our wedding planner and us, and I just finished spending all day driving around looking at wedding venues. Too bad I can't send them a video of me carrying around my phone with her on Skype the whole time looking at everything.

Just frustrating! I'm going to have her send a new letter of intent also, handwritten. I have another original copy of one she signed previously, but not sure if I should include that again or if I should wait for her to send me a new one that's handwritten.

They either lost the letters or didn't like the blue ink.

Btw, you didn't need to send in:

  • I-134 affidavit of support
  • 3 years tax returns
  • Letter from employer
  • 2 pay stubs

You take those to the embassy.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

yeah I know, but I did an i129f for an ex a few years ago who ended up not coming to the US. I included everything that I originally included in my previous petition plus a few things.

Hi,

I am picturing they lost your letters. Just send them again as requested and add chat logs with wedding plans and etc. MAYBE the fact you have applied before and she ended up not going to the States, now they want to make sure it's not going to happen again and need more proofs that she really intends to go.

And yeah, you don't need to include documents for the Affidavit along with your Petition, it's for the Embassy.

Make sure that your letters explicitly state that you intend to marry within 90 days upon arrival with the K1 Fiance visa.

3-Nov-14: Requested expedite by mailed letter with UN Human Rights Reports (Humanitarian Situation)

14-Nov-14: NOA2 (I-129F Petition Approved ~ E-mail & Text)

1-Dec-14: NVC Received Case

2-Dec-14: NVC Case Number Assigned

9-Dec-14: Embassy Received

3-Feb-15: "Package 3" Received/Turned In

25-Feb-15: "Package 4" - Received Interview Date

19-Mar-15: Interview ~ Approved

27-Mar-15: Visa Issued

I think they just lost the letters... and that is all they are asking for .... the blue ink? .... this has been recommended many times on VJ to show it is an original signature.

As far as plans... who can plan anything when there is no reliable time frame given for their approval?

You could call and talk to a Tier 2 and just reconfirm that it is just the letters of intent they are wanting.

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .

This seems to be a screw-up on USCIS. Blue ink would not matter. Looks like from your own posts you have a handle on it. Answer the RFE is the best choice and reply Certified Mail/Return ASAP.
