Hi! I'm having the exact same problem and your answer has been really helpful although I stil have one question:

Can we Get married back in Mexico and I would still be a legal and valid union?

Anyway as long as he is free to marry, no wait period, then you should be good to go, I have heard that marrying in Mexico is a pain.

But there is a waiting period (1 year) on the divorce sentence (not the divorce certificate), so we are wondering if the CO will give us a hard time if we marry in mexico (since the mexican law states that such marriages are VALID for all intents and purposes unless there was a legal process in which a judge would have to declare it invalid).

I know, it may sound pretty stupid specially since the divorce came after 4 years of separation, but the judge wrote that rule on the divorce sentence (even though the immigration process only requires the divorce certificate which is a shorter version of the former and which does not mention that particular subject). Anyway, it appears as if the marriage would be valid but could be annulled if one of us filled for it to be so. And I have no idea what will the CO have to say about this very particular matter during the interview.
