I just got a notice from the NVC saying that the documents were mailed the consulate in China. I contacted the consulate in China and they said that they received the electronic notice that it was on the way but that the physical documents which they needed are yet to arrive. Now they said that said transfer process can take 4 months or more. This has me really stressed as I was hoping to have her here with me early next year.

Has anyone gone through this? If so, how long does it usually take for them to receive the papers and schedule an interview?

Is it possible for my wife to visit Mr in the mean time? I'm unable to travel due work. What are the odds of getting a visitor visa while undergoing immigration proceedings?

Not sure if its same as K1 visa, but our case was sent from NVC to Guangzhou in about 1 to 2 weeks.

10-04-2013 We met online
11-21-2013 We met in person in Shanghai for 2 weeks

12-13-2013 I-129F packet sent via express

12-19-2013 USCIS NOA #1 (text and email) received

12-24-2013 USCIS assigns Alien Registration Number
12-31-2013 USCIS NOA #1 hard copy received
06-02-2014 USCIS web site shows NOA #2 approval
06-06-2014 USCIS web site shows case sent to NVC

06-xx-2014 Fiancee acquired birth, marriage, and police certificates from local police station (wrong)

ya, sorry, as

paper casefiles from NVC, when NOT USING NVC Electronic Processing for Guangzhou IV,

take about 2 to 4 months for the 'transit' into the IV Unit.

It's maybe a week from NVC to China, where (by treaty) that consular document must sit in a Chinese Bonded Warehouse for 1 to 3 months.

When using EP, NVC actually sets the interview date, about a week to 10 days after 'case complete' timetick, for 30 to 45 days out.

When not using EP, GUZ IV must wait on the casefile to physically arrive, although there's an option for the IV Unit, internally, to rely solely on the SAFEFILE version of the casefile. Hard to know about it, this is a 'hidden' area at GUZ IV, that decision to rely solely on what's in SAFEFILE.

When the casefile hits at GUZ IV, it has to be logged, opened, new background check started. Figure a month for that before she can be eligible for interview queue assignment - and then the interview has to be scheduled, another 20 to 45 days out.

As to the visitor visa, chances of - slim to none, as there's already a casefile in the pipeline for an immigrant visa.

Agree with Darnell. :thumbs: Since your wife has already signified immigration intent with your spousal visa application, a visitor visa is quite unlikely to be approved.

Well i didnt know at the time and i filed everything with nvc as soon as i got the requests. I dont suppose there is any way i can switch this to electronic or any way i cam speed this up? According to the NVC they forwarded the package early November, so i guess is sitting on some warehouse by now.

This is so inefficient and dumb. Hell i would take the documents myself id they allowed me to. I had no idea Chinese customs detained the documents for 3 months for no reason.

I guess ill have to go visit somehow. They need to find a more streamlined way to do this. The electronic filling should be presented as the main option in all aplicable cases. When i saw darnell advice about ep i had already filed, plus it never once crossed my mind it would make any difference other than convenience.

Not being able to visit makes no sense either, why would someone that is in a legal process for permanent residency in the US , suddenly stay as an illegal an risk deportstion down the line.

Cant they get that couples need to spend time together? She has visited the U.S a lot and not once has she overstayed her visa. This whole process makes less and less sense by the day.

I emailes the consulate about it and all i got was a drone response. Repeating that the physical documents have not arrived.
