It's getting close to the 5 month mark at the Nebraska Service Center and I starting to think about I-864 (I think this is the right form) AoS form for support. Well I have a co-sponser, my sister and her husband. Do both of them need to fill out this form each or just 1 and what documents do they need? I am thinking last 3 years of tax filing, 3 check-stubs and birth certificates for each of them. I also have 2 children ( they are adults now, over 18) that are working. Do I need them to fill out I-864 form also and provide last years tax returns, check stubs, and their birth certificates?

What about my adult children? They live with me still and both work. They only been working this year and with all 3 of us I make enough but since 1 only been working this year and the other did last year and filed tax for that year.

Since you don’t have sufficient income, just complete I-864 with past 3 year’s tax returns. Your sister makes sufficient to cover your husband then she need to submit the same (if she make really good income just provide recent year tax return). Your children don’t need to submit

You can do two things, have your children submit i-864As as household members or use your sister and BIL as a joint sponsor. If they only have 2 in their household this may be the better route.

You would sign a completed I-864.

Your sister would sign a completed I-864 and her husband and would complete an I-864a as her household member. They should send at least last year's tax return transcript, proof of citizenship or LPR status, and proof of current income.

Remember that if your children are living at home until 21 you need to count them on your I-864.
