I-797 petition to remove conditions on residence. ( RFE )

I'm a bit concerned about my situation with me and my wifes case. I just recieved a request for evidence letter today. After sending all the evidence that I have. I may have a couple of more things I could send but gathering things together as I just got the request letter today.

They are requesting that we send joint responsibilty or joint residence throughout the length of the conditional residence as we did not send sufficient evidence.

We currently have separate bank accounts. I sent our bank statements from a 2 year period but it is not a joint account yet. I don't know if it would make any difference now to get a joint account and then send this in? We also dont have any joint credit cards or car insurance or car titles. Since I had the same car since my wife first arrived here and no joint car insurance everything is still in my name.

So, the only joint ownership that we sent in was copies of joint Tax statements of 2012 and 2013, Separate bank statements with the same address, Joint medical cards showing same address and lending disclosers on our house but I only sent a copy of the front page of the lending disclosure of our home.

What should I do here? Should I go ahead and get joint bank accounts, insurance etc... and then send these in even though they're asking for documents throughout the marriage? I don't really have the money for a lawyer right now. I would really like to avoid that if possible.

If anyone has had a similar situation or any information I would deeply appriciate it.

i dont think getting joint account now is a good idea. You shoud have the joint account that span ur 2 yrs marriage.

Any uility bills? I would try to write a cover letter explaining why you dont have these things.

And try to get people to write letters for you and get it noterized.(at least 2-4 since you dont have much evidences)

Agree with ky0218. Adding a name to your statement is meaningless now. Your best bet is to explain anything on a cover letter, and to include some affidavits and pictures. You can't send what you don't have and get ready for an interview if your RFE response doesn't satisfy USCIS. Good luck.

Thanks guys. I have sent in a few utility bills where our names are both on the bill. I've sent 9 affidavit letters signed from friends and family .I've sent 3 packages of photos. I sent 2 years of tax forms but these were not the tax transcripts. These were W2 and 1040 forms.

We haven't taking a honeymoon yet cause we can't afford it right now. So we don't have any proof of any trips taken. I will send the rest of what I have some updated things. Send in the tax transcripts and a full copy of our house loan and a cover letter see how this will do. You think getting a lawyer would make any difference at this point?

No. Dont need a lawyer

Hopefully, they will approve you with what you sent. Otherwise, you will have an interview

day 86-- 07/05/2012-- Received my GC in the mail.

day 1 -- 04/07/2014 -- ROC Package delivered to VSC

day 16 -- 04/23/2014 -- Walk-in Bio.

day 197 -- 10/20/2014-- Approval Letter received dated 10/16/2014

day 202 -- 10/25/2014-- GC received

What I meant was these were the things that I have already sent ( in my comment above), the affidavit letters, photos, bills other documents, before the RFE. Appreciate the help everyone. I will send what I have and see what happens. I wish I would have known about all the requirements before.

order the tax transcript and send it in.

Any bills(like cell phone, electric, car insuarance) that have either your name or your spouse name with the same address.

Highlight from the bank statements that who pay what bills and explain in the letter.

This would show them that the couple are paying bills and living together.

Thanks, everyone has been a big help so far. Helps to eliminate some stress about this whole situation. I will send in everything that everyone suggest and every bill that I can gather and that was good idea about highlighting some transactions in the bank statements. So thank you for that.
