I-601 and Adam Walsh Act

Timeline

My husband and I filed his I-130 in Sydney in mid-July. His visa was denied and he was required to file an I-601 which was submitted in November and forwarded to Bangkok for adjudication. I emailed both Bangkok and Sydney regarding our application and how it would be affected. I did not hear back from Sydney, but Bangkok responded and their response is below. Hopefully this new law will not cause much delay for those who have already filed both the I-130 and the I-601.

From Bangkok-

We will notify you if we need additional documentation. We will need to review the underlying I-130 petition, but we may not need any additional documents.

The U.S. Consulate will forward your original I-130 petition for USCIS review.

I do not foresee additional delays unless the additional security checks bring up additional derogatory information. Thank you for your patience will we implement new procedures for the Adam Walsh Acts.

I have another question regarding our application. I have recently learned of a new law that may affect our I-130. (Adam Walsh Act) Will this delay our application? Will we need to refile? Do you need me to provide any additional documentation? I have recently

received a government security clearance involving fingerprint check for my employment on a DoD contract. I am adjudicated in JPAS 8/6/2006 NACLC 7/31/06.

On November 20, 2006, USCIS Bangkok received the Immigrant Visa Waiver

Application I-601 from the U.S. Consulate in Syndey, Australia. We ordered

and have recently received your husband's permanent USCIS file. I-601(s) are

adjudicated in date received order. We will review the file and evidence

submitted with the waiver application. We will approve, deny, or request

additional evidence. I cannot give you an exact timeframe for the final

adjudication of the I-601. Processing time can be as long as 6 months or as

short as 2 months depending on our backlog and other officer commitments.

We're in the same situation as you. We filed the I-130 on July 31, 2006 and the I-601 in November 20, 2006 in Sweden.

Both files are now in London, and they assured me that the waiver and the petition would be adjudicated simultaneously.

I'm glad they're handling our cases with common sense :) Good luck!

Apr 07 2007: Another RFE from London

Apr 19 2007: RFE, The Sequel, sent back to London

Apr 20 2007: Our I-601 case goes Under Review in London

May 18 2007: Stockholm calls: Waiver APPROVED!!!

May 31 2007: Visa issued

June 15 2007: Hubby is home!!!

May 09 09: Filed I-751 Removal of Conditions

May 13 09: Check cashed

May 20 09: NOA1 received

June 05 09: Biometrics done

Oct 14 09: Approved

i just received an email from the barbados embassy saying that they are no longer accepting I-601's per a directive from USCIS and all previously uncompleted I-601's will be forwarded to the USCIS in the US. has anyone else heard this?
