USEM guidelines states:

An official letter of explanation from the NBI is required for any notation of "No criminal record" or "No pending case".

My wife went to NBI office in Marilao, Bulacan yesterday to obtain her clearance and asked for this additional letter and was politely informed that No criminal record means No criminal and there would be No letter of explanation.

Anyone have recent interview experience and should we be concerned if she doesn't have this letter?

Confused as always.

NO CRIMINAL RECORD and NO CASE PENDING could mean she is in the NBI's database for a past offense.

If her NBI says either of those two phrases, she needs to return to NBI and request a letter of explanation as to WHAT she is in the database for. Once she finds out the cause is, she can begin to "fix it" before her interview. She may get a 221(g) from the CO at which time the embassy will ask NBI for the explanation. It will take some persistence from her with the NBI but this can be a deal breaker if not taken care of soon.

If her form says something like NO RECORD ON FILE or NO DEROGATORY RECORD then she has nothing to worry about.

Ah, it's all in the semantics isn't it. I was unaware of the options: " NO RECORD ON FILE or NO DEROGATORY RECORD". Asawa is not in their database.

Another relief in our journey.

NBI won't issue the letter without a request from USEM. You can try to contact USEM to get this request letter from the embassy before the interview, but most times it doesn't happen until the interview, then you get a 221g requesting the explanation letter. Adds more waiting to the process for sure.

I would try to contact USEM about getting the request from them to take to NBI.

Hank is right, you can't get that letter from NBI without usem request for interview. I experience it, I have NO CRIMINAL RECORD annotation and I wait 2 weeks after my interview until USEM send that request. And another 2 weeks before NBI send it back to USEM. And another week before USEM process it. Why took that long? Have NO idea.

Well my asawa's record indicates "No Record On File" so I don't think we will have any delay (at least for that issue).

Noticed that your city is listed as San Jose City. I know there are many in PI with that name. My wife is currently living in San Jose del Monte, Bulacan. Is that the same as your's? Just curious.

I need to backtrack here. You will not get a letter from NBI on your own accord. What I meant to say is to go to NBI and try and figure out what your in the Data Base for. Once you know that you will have a head start in collecting your proof of innocence for when the request goes to the NBI which in turn will help with the letter of explanation. Don't leave something in the hands of a Government worker to solve, take ownership and do it yourself.

Case in point. My wife had some dismissed court cases some 10 years ago. NBI only had a few of the cases noted that they were dismissed but others were still "open". She immediately began the research at her local court and was able to get all the documentation to prove that her cases were satisfied with a dismissal. She went to the Manila NBI office and presented the documentation and the letter (221g) was sent over to USEM, answered to the CO's satisfaction, and her visa was issued one week later.

Brassballs" I'm from different city but close to that. Well if your wife annotation is NO Record on File then your good! Goodluck on this journey.

Too many San Jose's, as well as Sabang's, San Fernando's etc., etc. Ha Ha.

Thanks for the goodluck. Hopefully asawa and anak will travel shortly after the first of the year.

By the way, NBI does not her name / person in their database. Can't even begin to imagine how one would begin to correct errors. Maybe P's would help!

Hi! So it just took you a little over a month before you got your visa? I was interviewed Oct 7 and up until now there's no update either from usem or nbi. What did you do? I messaged you and hope you'd reply. Thanks! :)

Francine, I was 22g for 3 months due to nbi issue. So far I'm already here in USA after waiting 90 day's after my interview. You have to wait for usem to send you a request for nbi interview.

3months?? Wow that's so freaking long!! :( 1month down, 2 to go!! Anyway, when did you have your interview? Did they still ask you to go to nbi? Because i've read some arent even required to have an nbi interview.
