Hey guys,

Getting ready to send my I-751 in with about 2 months before it expires. My spouse and I have lots of joint finances, insurance, credit cards, etc. Along with pictures from the last 2 years. Is it necessary to include any affidavits with the form? and has anyone been approved without including any? It seems like weak evidence to me, so I'd rather not waste the time of getting them done if it's not needed. We had my green card approved in just over 3 months the first time around...

Any advice/experience with this would be appreciated.

Affidavits are optional, no need if you have a lot of commingling evidences. Good luck.

The best evidence of all can be Wills, medical powers of attorney, HIPAA releases, and similar. Because you have time before your ROC deadline, consider creating the above and including copies of them in the package. (These documents are even better to have in "life" than they are for ROC purposes.)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Our evidence was much like yours and we felt that it was pretty strong so we didn't include affidavits. We were approved with no issues.

01/27/2011 - Trevor's N400 submitted
02/18/2011 - Married
04/02/2011 - NOA1 hard copy received - priority date 03/30/2011
07/08/2011 - Trevor is now a USC - called USCIS to request upgrade of the petition.
08/02/2011 - NOA2
09/08/2011 - LND case number received, medical booked
09/26/2011 - Case complete at NVC
09/30/2011 - Interview date assigned
11/08/2011 - Interview - approved!!
11/10/2011 - Visa in hand
12/04/2011 - POE in Atlanta
12/12/2011 - SSN number received in mail
12/12/2011 - Welcome notice received
01/06/2012 - Green card received
09/06/2013 - File for Removal of Conditions
10/01/2013 - Biometrics for ROC
02/03/2014 - Card production email received

02/17/2014 - 2nd card production email received

02/28/2014 - 10 year Green card received

Affadavits have no weight in my opinion. I was a divorce waiver and I didn't feel the need to have other people telling immigration how my marriage was. I think I could do that on my own, since nobody would know more than I when it comes to my marriage. So no, they are not important... In my opinion. Goodluck

07/01/14- Biometrics Appt

09/08/14- RFE response received by USCIS

09/22/14- 10yrs GC Approved!!

My impression from talking to USCIS is that if they have reasons to wonder about the validity of your marriage affidavits might be helpful, but they're certainly not required. If everything else points to the fact that you lived together and did things as a couple with family and friends, affidavits will just tell them what they already knew. If you had some circumstance requiring you to live apart, affidavits that you visited frequently and spent time with family and friends when together might resolve the doubt created by separate residences.
