Hello!

Alright, I just gave my w-2 to my employer, my income is well over the designated amount. However, I have an issue.

My employer is a family member and due to certain circumstances, they were not supportive of the wedding. I went through with it anyways, not to their knowledge.

I filed as single in my w-2. Will this affect anything when I send it my AOS packet or even at the interview? I don't have an issue with my taxes being withheld as single and I fully plan to file as married when federal tax returns occur because I'm having another ceremony that includes my side of the family before I need to file federal taxes.

I read somewhere that there is no problem with a w-2 saying single, the issue is only when I file federal taxes in Janurary - which I haven't done yet.

Please advise...

For the most part you likely won't have an issue in regards to the actual AOS. However, it may come up at interview why your family wasn't at the wedding, and your spouse will need to explain why. That may open up a whole other can of worms. For instance your spouse will truthfully reply that your family doesn't know, they do not support your marriage currently, and now it looks like you're hiding your marriage by filing single instead of married like required by law. Even in Canada I was asked why my in-laws and my husband's friends were not at our wedding. Truthfully, it was a small wedding by choice, and they couldn't get the time off work or have the available funds to travel (his brother and his best friend are in the military.) It helped that not all of my family attended either.

Well, honesty isn't a bad idea. My family said they don't want to be involved because of his lack of a college degree and they don't think he's good enough. I love him and he is good enough for me because of who he is. I'm sure the consulate could understand. On the other hand, we also decided to be spontaneous. My family was in a different country and there were health circumstances that did not allow them to attend. They've warmed up to the idea since, so I wan to be fair to them and have another "makeup ceremeony" when my husband is in the states with me. The third option is that at the interview, he could say that its what an accountant advised me to do because he isn't in the states yet.

Whatever the truth is. I'm just letting you know some questions that may be asked, and it's up to him to figure out what the truth is and respond accordingly. If they weren't warm to the idea then, but are now, that's the truth. The truth is also that you received bad information from an accountant. Thus this shouldn't be an issue but it's a good idea to know things that may be asked so they don't seem so "shocking." :)
