She should be covered under the FAMILY MEDICAL LEAVE ACT.

http://www.dol.gov/whd/fmla/

Unless her company is too small. And usually they would be big enough if caring for disabled children.

She just needs to file the correct paperwork with her HR for the company and they are required to give it to her if she is qualified.

Also, she should be covered under short term disability if she was given the opportunity to purchase it. Most companies will do that now since it is cheap and covers 60 percent of your expenses for up to 6 months.

Be aware that all normal leave must be used up before the FMLA kicks in. And I am pretty sure that FMLA also only covers 60 percent of your normal pay. But I am not exactly sure on that as I have never been through this, only witnessed friends that did.

I Filed my AOS on March and got

Notice of Potential Interview Waive letter

so there is no interview needed.

Some have received the interview waiver letter and have still received an interview appointment. The waiver is no guarantee you will not interview. If you are approved without interview, then none of this will be an issue, since they will have accepted the I-864 as it was when you filed.
