Hey, can someone pls help me. I sent out the last package including the affidavit of support from our cosponsor. The frankfurt consulate now emailed my husband saying that my affidavit is missing and to include my W2s.

My problem is (and this is why i didnt send it the first time) that i have both, the US and German citizanship and have been living here for the last 13 years. Im 25 and therefor have never worked in the USA or filied for taxes...

What should i so???

Even if you never earned any money and have no assets, you, as petitioner, are the primary sponsor.

Fill in the I-864 fully (with lots of zeroes if needed), and add a short cover letter explaining why you never filed taxes.

Wait... have you been working in Germany?

If so, as US citizen, you need to file taxes with the IRS. You won't need to pay any, but you do need to file taxes if you work abroad. Back file taxes asap. then send evidence of it with your I-864.

I agree with the above. Even though you are not physically present in the US, as a USC you have the responsibility to file taxes, I believe up to $90k of foreign income is exempt from US taxes. As the sponsor you are always required to submit an affidavit of support even if you have 0 income.

If you didn't work in Germany for the past 3 years, you can fill out the affidavit with $0 and attach a letter explaining. If not, you will have to file back taxes as suggested above, there shouldn't be any taxes if you are exempt, but I don't know if there are penalties for filing late.

Thank you for your help. Are you sure i need to file my taxes even though im a german citizian and resident too?

Yes, positive. You won't need to pay any due to bilateral tax treaties, but IRS wants the paper trail.

It shouldn't take super long, all you need is proof of filing, not them having processed it. And the last three years should be enough to get you passed at the embassy.

The problem is that she may not be able to get proof of filing if she does it by mail, I think efile is only good for the current year. Unless their is some other way of being able to file then it beats me, I'm not sure how it works when you're abroad.
