Hi All,

I am a US Citizen and I have submitted I-130 for my mother and it is approved. She is here on visitor visa.

Now i am planning to file I-485 for her ( as she is eligible for AOS since she is here in US).

And here are the forms that i am planning to send.

I-485

I-134

g-325a

I-864 & I-693 (These two forms i am not sure whether i have to send ?? There are so many I-864 versions i hope the one i listed is the one that i need to send). I don't need to file I-765 & I-131 as she definitely won't need won't need EAD

not sure about Travel Document.

Also her visitor visa will expire in a month from now. So does she need to leave to her home country or can she stay here as the I-485 is pending ?

Please advise. Really appreciate your help.

hi

you don't send the i134, you send the affidavit of support i864, the i134 is for non immigrant visa K1 for fiancés

the work permit i765 is free and if it comes sooner than the interview, she can get her social security number with it, even if she isn't going to work. It also allows here to travel legally in the US with no problem, and live in the US legally until her interview, so it's a good thing to send, and it costs nothing

if she's going to adjust status here she cannot leave, unless she sends the travel permit i131. overstay is forgiven when child is a USC and parent has entered the country legally

you will have to send a copy of the approved i130, since that goes in the adjustment of status packet and they have to tie the case together

Also if the i130 is at the NVC office, you will have to let them know that she will be adjusting status in the US

she will need to send a copy of the visa in her passport and copy of the i94, the i94 is not handed in anymore but a copy can be found on the website. Google i94 and you will find it

As stated above you should submit for the EAD/AP document by submitting the I-765 and the I-131. While it's perfectly possible to submit only for the AP, it's better to have both just in case. The EAD isn't only for work, it can be used to get an SSN, a DL or state ID, a bank account, etc, and it serves as an identity document and legal status. It's much easier to carry around than a passport and a letter btw.

Hi Mars,

I too am filing I-130 for my parents while they are in the US. Since your I-130 is already approved can you help me with the following questions:

1. Address - should it by my address since they are staying with me or should it be their Indian address which is mentioned on their Passport?

2.Your relative's address abroad - should I mention N/A or should I enter their Indian address which is mentioned on their Passport?
