Hello all. I'm new here so be easy on me. :unsure:

I have perhaps a silly question. I'm in the process of assembling the paperwork to file for a fincee visa, but I am currently out of work as I was laid-off last year. Ironicly, it was because I was out of work that I could meet and spend alot of time with her in her country getting to know her :blush:

At any rate, I'm in the process of looking for new work, but I'm not sure if I sould file now to get things in the process (and hope I have steady work by the time they ask for the I-134) or wait until I'm gainfully employed before filing at all?

If I file now, but don't have work by the time they need the I-134 affidavit of support, can I ask them to hold my file for some amount of time?

While I'm at it, what is the minimum income they look for two people? I currently have some income from a rental property and some consulting work I do.

Since the process can take anywhere from 6-9 months you be the judge as to whether you will be gainfully employed. The petition is valid for 4 mos. from approval with the ability to extend for 4 more mos if needed.

Typically for a K-1 they look at 100% (some would say 125%) of the poverty guidelines for the number of persons in your household + the beneficiary.

When I was in your situation I waited until I had a job before submitting my petition.

Living poor is no fun and can be fatal to the best of marriages. What are your fiancee's expectations for what life in the USA is like?

I dont know if anyone can give you an exact answer for your request because you are much aware of your life situation and how it goes considering you and your fiance. sometimes you plan for something but it wont follow your expectations. the two sides of your story is that you didnt care much about your last job because you want to be close to your love which is wonderful, but now you want to hold her there waiting until you find a another job and continue with it. maybe if you start the fiance procedure to win some time while you start a new job and commit to it and try further options like co-sponsor for sponsoring. Good luck :)

You also may want to ask this question here on the Regional Discussions board. I seem to remember reading something from others going through Vietnam where the consulate does not look too favorably upon the use of cosponsors for the affidavit of support.

It might be wise to wait until you have a new job and a steady income to show the consulate before proceeding.

Vietnam is one of the hardest consulates to go through if you have income problems. They scrutinize co-sponsor situations that many other consulates wouldn't think twice about. You need to have good documented income before applying.

Thanks everyone for the feedback. You gave me some things to think about (I had read Vietnam is pretty stringent due to high fraud rates). I hadn't thought of the co-sponser, but I'd prefer not to use it if possible. However, but will keep the idea on standby.

I have a pretty good earning potential when I'm working (and I work in an in-demand field), so I'm confident I'll find something eventually. I think at this point I'll probebly wait a bit so see how things are looking job wise.
