He needs to send Federal. I'm not sure regarding the pages. On my husband's most recent 1040, the annual income was on the first page. However it was on the 2nd page on older tax returns. He needs to check his 1040 to make sure.

All pages of the 1040 PLUS the W-2. Or goto IRS website and download a tax return transcript.

The reason they will not accept just a 1040 is because fraud is way too easy: You can get a blank form and fill in your own numbers. They want to see something coming from your employer or the IRS.

Send in complete 1040 wth W2s with the I-134, Affidavit of Support. Actually - the US Embassy in Manila seems to prefer 1040's. My wife had my 1040 and W2 as well as transcript. She gave them the transcript. They didn't want the transcript, they wanted the 1040.

The primary purpose for the CO to look at the 1040 is to verify income

Good day!

My fiance is going send me his 1040 form for K1 visa, but he asks if he only need to send the first page on it?

His 1040 has few pages.

He files for Federal Tax and State Tax, so he also asking if which one he is going to send.

Only copies the federal tax return and ALL pages, plus his W-2. Plus an original of the I-134 signed.

That don't make much sense.

1040 would be much easier to fake, It looks like the Tax Transcript would be better

I bet it was the pre screener who asked for that, they are usually Filipino's.

A lot of people will not have W-2's and other will not even get a 1099.

Trying to make sense out of how things are done at the Embassy, USCIS or NVC is an effort in futility.

Even the American interviewer did not want the transcript. It may be that each CO is different.

If folks don't have W2s or other income info, they're very likely to get a 221g - requesting that the information be provided.

Providing a fake 1040 would land the petitioner in jail. USCIS/NVC and the Embassy has access to tax records...they will check.

I am Self Employed, some years I get no 1099's since I shy away from commercial Jobs.

I have followed a few posters on here and it seem like the CO looks at the Total Income on the Tax Return if they have no W2 Or 1099's

I will have both Tax Transcripts and 1099's I sent in for the last 3 years when my girl goes to the interview.

That would be the best route to ensure that they get what they want. Some people have had problems with 1099s/Self-employment - with the 1st interviewer demanding W2 and 1040 not realizing what a 1099 is. You would think that they should know - but, for some reason, they're locked in on 1040's and W2s. Make sure that your fiance is aware of all it...if the 1st interviewer seems to be unaware of what a 1099 is and suggests that more info is required, your fiance can take it up with the 2nd interviewer - as you mentioned, since they're an American, they likely have a better idea of what they're looking at. She doesn't need to be concerned about ruffling feathers...she needs to be firm, polite and insistent if they persist in asking for 1040/W2. If they request additional info, they will tell her what it is that they want. Be sure to send all pages of the 1099. When working outside of the "norm," things can get a little dicey.

Why not?

If one works legally, they will have either a W-2 or a variation of the 1099.

Many self-employed people will not have either of those. When working with the public they are paid by the individual so no 1099.
