Puh....will I ever get this done. More and more questions arising. I hold a K1, got married.

1. If I file for EAD with AOS, do I need everything that it says in EAD package in addition to AOS package or do I just add form I-765??? E.g. I need two photos for AOS, do I need two additional photos when I file for EAD? Or copy of I94, do I need to add an extra one for EAD, when I already mail one for AOS?

2. Also, I have been here on several work visas before (last one was H1B), do I check yes, I have applied for EAD before or is a work visa different??

3. What do I put in question 16???

THANK YOU!!!!

1) Yes, you need to send two photos, another I-94 and so forth even you have sent them with I-485.

2) If you have applied for EAD (I-765) in the past then you need to check yes. If not then NO.

3)You put C9 in question 16.

If you have sent I-485 already, then make sure you attach I-797c notice of action for I-485 so that your fees will be waived.

Thank you for your reply. I am sending it with I-485, so I guess, the EAD package is it's separate little package (with photos, etc....) in the AOS package.

Does anybody know however if a H1B is a Employment Authorization?? I filed this with embassy in Germany, it is a work visa, not exactly a EAD.

H1B is a working visa, not the same as EAD card.

Done with K1, AOS and ROC

Treat each part of the whole AoS package as 3 individual ones, I assume you are applying for AP as well. So have a pile of paper for 485, 765 and 131, do what it says in the instructions for each form. By and large it's just a matter of a few extra copies and some photos.
