Ok a friend has 3 children from a previous marriage. He has nationality. He is from Egypt. His three children are 16, 3 1/2, 6 months. Now the middle child was born within the 5 years of him leaving the states(he left in 2008 and the child was born in 2011). Can he give him nationality by reporting a birth abroad?

Now the other two children will need to do the immigration process, right?

How does it work. They get visas and can travel then what happens when they are in the states? Do they get green cards? How do they become cititzens?

I am not very familiar with the process so anything will help.

Is it your husband's children or a friend's?

Anyways, being born within 5 years of leaving the US has nothing to do with derivative citizenship for children.

Your husband or friend must have be a US citizen who lived in the US for at least 5 years before the birth of a child in order for that child to be a US citizen.

For those children that are not US citizens, he must petition them with the I-130. Eventually, with immigrant visas they can enter the US to live with him. If they mee the 4 requirements of the Child Citizenship Act, then they become US citizens.

Because he lacked the time in the US to pass his citizenship on to the child he must petition them. However any that are under 18 are eligible to be USC as soon as they have their green card and are in the US in his custody,

This will not be over quickly. You will not enjoy this.
