Ok, I am new here but not new to immigration process. I have been fine until I get to the I-864.

My problem is I was under the impression that my pension and retirement would satisfy the financial needs of this form, but I am being informed by the immigration attorney in Thailand that that is a benefit and not an income and does not qualify since I have not filed taxes on it for the last 3 years for it is not required, because it is below $25,000. But, it more than meets the guidelines as an income for financial ability to support my wife.

Am I missing something????

Any help would be appreciated.

Of course you can use pension and retirement. You will show the source of the income coming in and write a brief why you didn't have to file taxes last for years (you weren't required to do so). And that's that,

Long as you are above for 2-$19334) you are cool.
