Hi guys first time poster.

My fiancée, who is the petitioner, got our NOA2 confirmation on 11th July 2014 and I recievied confirmation from the Embassy in London that they have the approved petition today the 8th August 2014.

I was going through the list of documents and other stuff I need to do on this section of the embassy's website (http://photos.state.gov/libraries/unitedkingdom/164203/cons-visa/iv_and_k_interview_checklist.pdf) when I came across the Affidavit of Support section.

My fiancée and I met while travelling in Australia and she informs me that she never done a Tax Return for 2012 and 2013. She is currently working and earning well above the 125% poverty line, so my question is would a letter from her employer, her pay stubs/slips and bank statements be enough to go along with the I-134 or is a tax return vital to bring to the interview?

Kind Regards

Niall

P.S. I know this type of question has been asked before but i still can't make heads or tails of it!

For a London interview she will be fine without a tax return. They love employer letters as proof. But when you file adjustment of status after marriage, there is another affidavit of support form I-864. It is stricter and she will be required to have filed her US tax returns. There is a provision for folks who were not required to file ...as in earning no income, unemployed, in school. But if she earned money anywhere in the world, and it was above the required income for filing, then she can not be excused. She can start looking now into filing back returns if needed so you can apply for your greencard in a timely. You will be fine for your K1 without.

Cheers Nich-Nick,

She is in the process now of filling in her Tax returns for the years she was out of the country so we'll have that sorted before the I-864 and hopefully before my interview too (just in case! )
