Just got my letter today in the mail, inquiring my residency status.

They will notify me when they have completed their review; whatever the heck that means.

I have one question, is there anything else I need to do to inform the canadian gov't?

And when tax season comes, I will have to file back home again, correct?

Uugghh gov't stuff-- I wish it was easier to move.

I think that is in response to the form you sent in indicating you left.

you will have to file "departure" or "exit" taxes for your 2014 tax year. This will be both provincial and Canadian taxes for the period prior to your move, then US taxes for the period after the move (unless you file jointly, then your Canadian income becomes taxable but you can deduct Canadian taxes paid). It's almost the same as your typical taxes except you have an extra form where you indicate your departure date and declare all of your capital gains as if you sold everything on the day you left. If you had no gains, then this is simple.

The US taxes get even more fun if you have any significant assets left in Canada :-)

Hello. I have been in usa for almost 5 months now. I have not notified Canada revenue of my departure yet. Who is it that I contact and what is the process. Should I wait until I actually have my adjustment of status ?

There is that 1 form that one "can" fill out..but it is not a must.....NR73.....When it comes to filing ur Cdn taxes.....on the very first page there is a spot where one enters when they became OR ceased to be a Cdn resident....I just put in the date I left canada.......and for fun I applied for the GST rebate, which I knew I could not get as I made too much $$$, but they sent me a letter more or less saying, sorry you ceased to be a Cdn resident on.....(the date I had put down) so thats how I knew I was good to go,lol I called Revenue Canada and asked if I had to fill out NR73 and they said no. I don't own any property, I have kept 1 bank account open but it has less than $1 in it, so a pretty easy case.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

It is a confusing topic thats for sure. I called a US/Canadian Tax specialist. I was all concerned about the sale of my house in Canada..would it be taxable in the us. Apparently not as its not "Income" But for sure money I made this year in Canada will be taxable in the US if I file jointly with my husband for 2014. If I file single it would be too low to be taxable. In Canada it will not be taxable either. (odd you have to claim it in the US if you earned it in Canada before you left...but you do!)

Big problem is getting the money from the house to the US. It was a "principal residence" and even the US tax fellows have an exemption up to $250K for single and $500K for married on capital gains on sale of principal residence.

Now physically getting the money there is another story.

I have already called CRA and advised them I am leaving.

If anyone has any experience getting funds from a house sale to the US please advise. I'm leaving in 2 weeks

You can't file single.

In either country.


You do not have to include your husband's income on your Canadian taxes however. That is the Canadian equivalent of MFS.


The only time you MUST include your husband on your Canadian taxes is while you're married, living in Canada and collecting any benefits (like CCTB) which is based off of family income.

U can fill it out if u wish too....but u do NOT have to.....it just helps determine ur status.....putting down the date u CEASED to be a Cdn resident on ur tax forum notifies them.
