Hi everyone,

A very quick question. I paid for my mom and dad's AOS fee last June and I have been so busy with work and had issues with my health that I have just completed the I-864 documents. It has been about 2 months since I paid. Will this affect processing of my parents' documents?

Please advise. I am so worried.

Hi, you have a year to submit your documents to NVC drom the day they received your case. I don't believe it will affect anything since it takes 30 days to review the documents you send. Nevertheless the sooner you sens the required documents the fastest you will be out of NVC

Actually, it's a year from the last time you communicated with the NVC. Meaning that the "one year" resets every time you file something, or pay a fee, or contact them, so they won't consider the case abandoned. So once you submit the AOS, your year resets again. When you pay the IV fee, the year resets again and so forth, up until you have your interview and apply for the visa.

One Year Contact Requirement

After you receive notification that the NVC is processing your case, you must contact them at least once a year. If you do not contact the NVC for one year, all documents and fees on your case will expire and you must resubmit them to resume processing.

This does not constitute legal advice.

You delayed the process by not submitting right away but no worries, their cases are still active. Nothing to worry about.

Next step is pay the IV fees and submit the beneficiaries' civil documents.
