My situation: I'm a US Citizen applying for my wife in India. AOS fee has been paid and am currently putting together the package. I'm currently unemployed, so, I'm using my sister as a joint sponsor. Both my sister (unmarried) and I are living at our parents house, and neither of us are claimed as dependents by my parents.

1. Does my sister file an 864 or 864A? I assumed 864A since we both live together...

2. Since both my sister and I live at the house owned by my parents, do I need to include my parents in the household income? Are my parents required to fill out 864 and 864a forms since we all live at the same address?

3. When I'm filling out 864 form, under household income, do I enter 1 for "OPTIONAL: If you have siblings, parents, or adult children with the same principal residence who are combining their income with yours by submitting Form I-864A, enter the number here." and Have my sister fill out the 864A form? Also would the household income size be 3 only, since it will be me, my wife and my sister? Eventhough my parents also live at the address...

Thank you so much for the help...I'm just really confused and just wanna be sure and do it right the first time...

Have the sister file her own separate I-864 as the joint sponsor instead of an I-864A as the household member. A household member is used to combine their income with that of the sponsor filling out the I-864. However, you have no income to combine with. She can be the joint sponsor and her household size will only be 2, herself and your wife. Your household size will also be 2, you and your wife. The parents are not included.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ

Couple more questions....

1. Is better to put N/A or None for blank spaces, such as, Beneficiary's alien#, i don't have a middle name, preparer's information (i'm filling it out myself), Family member 1,2,3 information, etc?

2. I printed off Tax Return Transcripts from IRS website for last three years for both my sister and I, do I still need to include W-2, 1099s...for all three years? we have filed as either single or married filing separately...
