I am a Brasilian and was married to a US citizen in November 2013. We filed an i130 in June. We've been together since 2011. We travel every month to visit each other. One month I go to US and next month he visits Brasil. Neither of us have any criminal and his salary is well above the uscis guidelines so I'm confident our i130 will be approved. But it's very hard being away from each other and we want to file adjustment of status. Here are my questions. My husband separated from his ex wife in 2010 he filed for divorce in 2011 but his divorce didn't finalize until June 2013. Again we were married in November 2013. Will that be an issue? Will doing an aos negatively affect my i130 application? I'm afraid to do the aos while here on the tourist visa while the i130 is in process. Are my fears legitimate or should I assume everything will be approved being we have strong proof of a true marriage we meet the financial guidelines and no criminal history? Any help suggestions or input would be greatly appreciated. Thanks!!

One more question I have. The one thing I'm worried about doing the aos is the inability to leave the country during the process. I have a grandfather who is sick and unfortunately I wouldn't be surprised if his condition deteriorates more. Can I use this as a reason for advanced parole to visit him? Do most people get approved for advanced parole wanting to visit sick relatives?

You would file for the joint AP/EAD, can take 90 days. There is an expedite option, death of a close relative should be enough, but never good to assume that will happen.
