ok, a search for T1 on the Revenue Canada site comes up with a bajillion forms. Which one?

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

PLEASE DO NOT PRIVATE MESSAGE ME OR EMAIL ME. I HAVE NO IDEA ABOUT CURRENT US IMMIGRATION PROCEDURES!!!!!

This being the second yr of filling out USA taxes, I have never been required to send in any Canadian Documentation, of course Im not in New Jersey!! Hope it works out for ya

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

it says ....

If you were a non-resident of Canada throughout 2005 and you are reporting only income from employment from Canada , us the package for the province where you earned the income

Now I am confused to I fill out the form zggy posted or the one from my province? The only difference I see is the first page.... On the one zggy posted is says to check the box that best descibes your residency status as of December 2005 ... it doesn't say that on the form from Brtish columbia :unsure:

Marilyn if you left Canada to live in the US in 2005 you use the forms for your province. Put non-resident in the part about spouse (and you don't need to include anything else for him), and put the date you left Canada in where it asks for your last date living there.

If you left Canada prior to 2005 you need the Non-resident tax forms Zyggy posted for Reba.

If you didn't earn income in the US (i.e. all your income was from Canadian sources) make sure you put a letter in with your tax submission stating that. Then they won't pro-rate your tax credits down. :)

As for your total income tax deducted, phone and yell at them! :yes:

I only have about 400 dollars worth of income to claim....

Well, you probably won't even have to pay taxes, so that's why none were deducted. (Sorry, I'm exhausted right now and not thinking clearly.) So yeah, just do the provincial forms and fill in what you can.

I'm bored and trying to put off studying, well I dont really have to study, as its just reading for next semester, which does not start until May 15!! So will give an update on my Cdn taxes:

Bit of info: I moved to the USA Dec 2004, but was still being paid until Jan 2005, thus still had to file for 2005!! Received EI for the maximum allowed time in 2005 as well!! So between EI and my little bit of Cdn military pay, not a lot of $$$ to claim. Made no $ in USA as I was a student!!

Not many of the software programs deal with a non resident tax return, but I found http://www.quicktaxweb.ca/content/index/index.php?b=intuit did a fairly good job!

1 item i was not certain about was section 217. If I filed normally, I calculated I would have got back around $90. But by using section 217, it jumped to $2200!! Sounded too good to be true. So I called the International tax office and asked a few questions. The fellow said it sounded like I could use section 217, and if I was incorrect,they would re-adjust it!! So really I had nothing to loose!! Of course one doesnt really like to trust the government, but I figured it was worth the gamble!! So I sent off the taxes with section 217!!

After a month (sent IRS taxes in and received refund!!) international tax office called me and asked a few questions!! I guess on schedule "A" which deal with foreign income, was blank, which I explained I didnt make any $$ in USA as I was a student, he was happy with that, and he noted he appreciated my cover letter!! I just thanked them for a great job on answering my questions on the phone!! maybe just a little buttering them up! lol But they were very good.

I checked online http://www.cra-arc.gc.ca/menu-e.html#1 and see I got my refund, minus a few hundred $$, but I'm not complaining!!

So the software seemed to do a decent job. I still have not received the refund as it is being mailed to me. According to that website it is to be mailed may 4. So in total, by the time I recieve it, should be around 2 months! 2005 should be the last yr I have to file for Cdn taxes!!

Now I just have to decide what to do with my RRSP!! Cdn $$ is strong so may be a good time to withdraw!! I have no income, as I am a student. Guess I have to figure if Virginia what a share of the $$$. Some States do, some do not!

So if your in doubt call the international tax office, as they seem to be well informed, and be prepared to wait awhile for your refund. On that link I provided, you can change your address, check previous yrs tax returns, etc. cheers

Reba, I feel your pain. Which is why I had Mark Serbinski do my Canadian and U.S. taxes this year. It was expensive, but my refund covered his fee. He knew about state as well as federal laws pertaining to RRSPs. He knew my status for the coming year would still be "resident" in RevCan's eyes because I married a Canadian who is living in Toronto. I'm a dual, my head is spinning, and I have better things to do than give myself grey hairs doing research and arguing with uninformed accountants.

H&R Block is known as H&R Blockhead when it comes to cross-border taxes. They may seem like only game in town in NC, but Serbinski does everything by email and FedEx. Painless. One last thing: since I'll have to produce tax returns for my husband's K3 interview in Montreal, I want them done and done right. My peace of mind is worth the cost. Hey, we won't be doing dual returns forever.

Okay, here's a question for Canadian taxes...do I file as a non-resident? I only moved here in March 2006. The whole of the tax year I was in Canada as a resident....so...do I just wait til NEXT year to file as a non-resident?
