Hi guys,

Just wanted to thank you all for your help. I have contacted the NVC and got my case # and IIN I did the following:

1) I filled DS-261 online and submitted the application.

2) After one day I received an email from NVC stating that I can pay the AOS fees and I already paid that and it is showing PAID now. I log in now and I see the IV pay now link is active but when I click it, it never shows any amount to select and displays this message: Total Amount Selected: $0.00

Thanks Darnell for the links you provided me they are really helpful.

I have the following questions:

1) My joint sponsor is my uncle and he is in USA and I am in Dubai, is it fine if he sends me I-864 which he filled scanned and by email? All other documents as well like pay stubs and IRS? So I will print them out and prepare the AOS package.

2) Now the status of AOS is PAID so what happens if I don't send my AOS package immediately, because my uncle is waiting for IRS tax to get delivered to him.

3) My uncle says no need to send employment letter he says pay stubs are enough to show that he is working and has income, is the employment letter important (required).

4) 2013 & 2012 IRS tax return are enough or it should be 3 years meaning 2011 year IRS is required?

5) My wife is a student and she does not have a job so no income. What shall she fill in I-864 regarding income? Do I have to provide a proof that she does not work, or student letter from her university is required stating that she is a full time student.

Thanks again

1. have the joint sponser give all to the petitioner, not you, original documents. petitioner must make an I-864 regardless.

2. nothing. your petitioner has up to 1 year to submit all AOS paperwork from the 'paid' date.

3. no - is either/or. paystubs are for current annual income - prior year annual income shown via tax data/tax returns.

4. instructions say 1 or 3 years - never 2.

5. she'll need to show something about prior years income and current annual income - even if at 0. she's the petitioner, her I-864 is required, she is the primary sponsor on you. you do nothing for proof - it is HER, on HER, to show the proof.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

So regarding 4. my joint sponsor is sending me 2. Shall I include both of them or just last year?

And for 5. My petitioner will fill I-864 but is she required to provide a proof that she has 0 income? Like university letter stating that she is a student? Since me and my wife live outside US and she has no income she does not fill tax returns. How will she prove that?
