Hi Folks

I am about to cancel my K-1 Visa and get married in my fiancée home/employment country.

Questions:

1) will it have any implications on getting a tourist visa to the US?

2)Can you get a tourist visa while waiting/applying for CR-1?

We have not decided when we want to file for CR-1.

Personally my husband and I decided against attempting this, even though it can be done. We felt that from a money perspective, if we risked it and he was denied entry we've just burned through money without anything to show for it. Instead we decided to take a different route - we are meeting in locations that don't require entry to the US. Whatever is the cheapest major city to get to outside of the US at the time and treating it as a vacation. This past weekend we met in Frankfurt. We did this because we felt we didn't have enough evidence to convince a CBP official of his intent to leave - unemployed and without any major assets to show he has ties in the Netherlands (home). If he were employed, I might be willing to risk it then.

Before you cancel and start over with the CR-1 think through it carefully - all the pros and cons. My lawyer recommended the CR-1 route for us but the wait is so long that sometimes I regret it. I miss him and a K-1 would have been faster (though financially CR-1 better in the long run).

My CR1 was filed in August 2013 and we were apprehensive about applying for tourist visa as it felt risky.

However, we consulted immigration lawyer, Rajeev Khanna in USA. He advised that the chances of tourist visa getting approved when your immigration visa is in process is bleak...However, it will definitely not have any negative repercussions on your CR1 process, rest assured.

I applied for B2 visa in December 2013 and to our surprise, it was approved. I went to USA and stayed with my spouse for almost a month.

22 Feb 2014 - case transferred at NVC (post clearance and acceptance at USCIS)
18 Apr 2014 - Paid AOS fees
29 Apr 2014 - Paid IV fees
05 May 2014 - Filled DS 260 form
03 Jun 2014 - Submitted AOS and IV documents
07 Jun 2014 - Acknowledge by telephone representative of AOS & IV documents received
08 Jul 2014 - Checklist from NVC, mentioning list of docs to be brought at Interview
10 Jul 2014 - Interview date confirmation on call
11 Jul 2014 - Received mail notification of Interview on 19 Aug 2014
13 Jul 2014 - Fingerprinting done at VAC Mumbai
11 Aug 2014 - Medical Exam at Rele Clinic Mumbai

As long you asked it really depends on the consul if he wants to give it or not lol ; because i applied for one and got denied the reason was : Wait for your immigrant visa lol
