Hi there,

I am in the process of filling out my K1 package and I have encountered a possible issue.

When filling out the I-134 it asks you to provide the most recent federal tax returns.

I have been living abroad for the past 4 years studying in Europe and living with my fiance and have not filed any tax returns during that time. My current salary in the US is above the poverty line but I have no proof of that from the IRS since I haven't filed for years and will not be able to until the next tax season.

What should be my action steps in this situation?

I appreciate any help on the matter :)

Hi,

US citizens are taxed on their worldwide income even if nothing is earned in the US.

Did you make more than $9600 in any of the last three years? If yes, then you need to file US tax returns for those years.

If you made less than $9,600 in any year, then you provide a signed statement that you were not required to file because your income was below the minimum threshold to file.

I did not make above the $9600 mark so I guess I just have to make the statement.

Should the statement be made and signed by me and is there any official guidelines for what it should look like?

No guidelines for the statement, other than being sure to state the reason you were not legally required to file. Stating that your income was below the IRS income requirement threshold for filing will work.
